Política de Uso Aceptable

El uso del Servicio (en adelante referido como "Virtua.Cloud") y/o los Servicios proporcionados por VIRTUA SYSTEMS y sus subsidiarias (en adelante referidos como "Virtua.Cloud", "nosotros", "nos", "nuestro") está sujeto a la siguiente Política de Uso Aceptable. Al utilizar el Servicio y/o los Servicios, aceptas cumplir con esta Política de Uso Aceptable. Además, también aceptas que informarás a cualquier otra parte, a la que hayas otorgado acceso al Servicio a través de tu cuenta de usuario y/o acceso a los Servicios proporcionados a ti, y exigirles que cumplan con esta Política de Uso Aceptable.
En adelante, "Usted" se aplica tanto a Usted como a cualquier otro tercero al que se le conceda acceso al Servicio y / o los Servicios a través de usted.

- Do not try to probe, scan, or test the vulnerability of any system or network.
- You are responsible for the actions performed by your account, including any damages resulting from your actions.
- Violation of these rules may result in suspension or termination of your services.
No uso ilegal o prohibido
Al utilizar el Servicio y/o los Servicios, acepta que no utilizará el Servicio y/o los Servicios con fines que violen la ley o que estén prohibidos por esta Política de Uso Aceptable. También acepta que no utilizará el Servicio y/o los Servicios de manera que puedan causar daños o afectar negativamente los Servicios proporcionados por Virtua.Cloud.
Uso prohibido
Los Servicios están diseñados para proporcionar recursos de computación en la nube a Usted. La siguiente lista proporciona ejemplos, pero no se limita a, de usos prohibidos del Servicio y los Servicios. De acuerdo con esta Política de Uso Aceptable, debe abstenerse de utilizar el Servicio y/o los Servicios para tales usos.
- Pornografía infantil
- Sitios web relacionados con las apuestas sin la debida licencia
- Software o contenido pirateado
- Propiedad intelectual que no te pertenece
- Enviando, transmitiendo o procesando Spam o CUALQUIER cosa relacionada con el spam
- Criptomoneda mining, farming, plotting o cualquier utilización intensiva de recursos relacionada con criptomonedas
- Nodos de salida ToR. Se permiten nodos de relevo ToR.
- Servidores proxy públicos
- Participar en ataques DoS/DDoS
- Uso que puede causar daños o destrucción en el hardware
- Cualquier otra actividad que sea ilegal en France y/o en la ubicación de Sus Servicios
Notificación a las Autoridades
Al descubrir o ser notificados de la violación de la Política de Uso Aceptable al realizar actividades consideradas ilegales según lo especificado anteriormente, Virtua.Cloud puede, a su entera discreción, informar a las autoridades pertinentes con el fin de protegerse a sí mismo y a otros usuarios del Servicio y/o los Servicios.
Terminación / Restricciones
Virtua.Cloud no tiene la obligación de supervisar los Servicios proporcionados a través del Servicio, sin embargo, Virtua.Cloud se reserva el derecho de restringir temporal o permanentemente el acceso a material y/o servicios proporcionados por usted a su exclusiva discreción, de acuerdo con los Términos del Servicio, la Política de Uso Aceptable y la ley aplicable.
Sanciones
If you violate any of the terms of our Acceptable Usage Policy or Terms of Service, you may be subject to penalties. These penalties are determined at the sole discretion of Virtua.Cloud and may include, but are not limited to, the following:
- Temporary or permanent suspension of your account.
- Fees or charges to cover any direct or collateral damages caused by your activities. These could include, but are not limited to, costs related to excess bandwidth usage, hardware repair or replacement, legal fees, and third-party claims.
If you intentionally violate our policies ('designedly' breach), you agree to pay any damages caused by such activities. An intentional violation is one where you knowingly and deliberately engage in prohibited activities, even after being informed of their prohibitive nature.
'Unwitting violations' are those where you unknowingly violate our policies or where the violation was not intentional. In such cases, penalties may or may not be applied, depending on the specific circumstances of the violation. This includes factors such as your past usage patterns and any prior violations.
If you are assessed penalty fees, you will be notified of the charges and are required to settle them within 7 days. If you fail to settle these charges within the given period, your account may be suspended, and the charges may be forwarded to collections.
We reserve the right to report any illegal activities to the relevant authorities, in addition to enforcing these penalties.
User Responsibility for Content
As a user of Virtua.Cloud, you are solely responsible for all content that you host, post, or share through our services. This includes, but is not limited to, websites, files, software, multimedia, and any other types of data.
You must ensure that your content:
- Complies with all applicable laws and regulations.
- Does not infringe on the intellectual property rights of others.
- Does not contain harmful or malicious software such as viruses, worms, or trojans.
- Does not involve activities that are prohibited by our Acceptable Usage Policy or Terms of Service.
If we discover content that violates our policies or the law, we may take action at our sole discretion. This can include removing the offending content, suspending your account, or reporting the violation to the appropriate authorities.
By using our services, you agree to comply with these content rules and accept the potential consequences of non-compliance.
Desactivación
Virtua.Cloud puede retirar ciertos Servicios proporcionados a través del Servicio al recibir notificaciones de eliminación de propietarios de derechos de autor o gobiernos para cumplir con la ley. Este procedimiento se puede llevar a cabo con o sin previo aviso.
