Acceptable Use Policy

Het gebruik van de Service (hierna aangeduid als "Virtua.Cloud") en/of de Diensten geleverd door VIRTUA SYSTEMS en haar dochterondernemingen (hierna aangeduid als "Virtua.Cloud", "wij", "ons", "onze") is onderworpen aan de volgende Acceptable Use Policy. Door gebruik te maken van de Service en/of de Diensten, stemt u in met het naleven van deze Acceptable Use Policy. Bovendien gaat u er ook mee akkoord dat u elke andere partij die u toegang heeft verleend tot de Service via uw gebruikersaccount en/of toegang tot de aan u geleverde Diensten, zult informeren en van hen zult eisen dat zij deze Acceptable Use Policy naleven.

Hierna is "u" van toepassing op zowel u als op elke andere derde partij die via u toegang krijgt tot de Service en/of de Diensten.

• Do not use the service to send spam or phishing emails.
• Do not use the service to distribute harmful or malicious software.
• Do not use the service to mine cryptocurrency without explicit permission.
• Do not harass or harm other users or the service itself.
• Do not use the service to distribute adult content without appropriate measures.
• Do not use the service for high bandwidth activities like media streaming or file sharing without Virtua.Cloud's permission.
• Do not try to probe, scan, or test the vulnerability of any system or network.
• You are responsible for the actions performed by your account, including any damages resulting from your actions.
• Violation of these rules may result in suspension or termination of your services.

Geen onrechtmatig of verboden gebruik

Door gebruik te maken van de Service en/of de Diensten, stemt u ermee in de Service en/of de Diensten niet te gebruiken voor doeleinden die in strijd zijn met de wet of anderszins verboden zijn door deze Acceptable Use Policy. U stemt er ook mee in de Service en/of de Diensten niet te gebruiken op een manier die de door Virtua.Cloud geleverde Diensten kan beschadigen of anderszins negatief kan beïnvloeden.

Verboden gebruik

De Diensten zijn ontworpen om cloud computing-resources aan u te leveren. De volgende lijst geeft voorbeelden, maar is niet beperkt tot, verboden gebruik van de Service en de Diensten. In overeenstemming met deze Acceptable Use Policy dient u zich te onthouden van het gebruik van de Service en/of de Diensten voor dergelijke doeleinden.

• Kinderpornografie
• Websites gerelateerd aan kansspelen zonder geldige vergunning
• Illegale software of content
• Intellectueel eigendom dat niet van u is
• Het verzenden, doorgeven of verwerken van spam of ALLES wat gerelateerd is aan spam
• Cryptovaluta mining, farming, plotting of enig ander resource-intensief gebruik gerelateerd aan cryptovaluta
• ToR exit nodes. ToR relay nodes zijn toegestaan.
• Openbare proxyservers
• Deelnemen aan DoS/DDoS-aanvallen
• Gebruik dat schade aan of vernietiging van hardware kan veroorzaken
• Elke andere activiteit die illegaal is in France en/of de locatie van uw Diensten

Melding aan autoriteiten

Bij ontdekking of melding van schending van de Acceptable Use Policy door het uitvoeren van als illegaal aangemerkte activiteiten zoals hierboven beschreven, kan Virtua.Cloud naar eigen goeddunken aangifte doen bij de bevoegde autoriteiten om zichzelf en andere gebruikers van de Service en/of de Diensten te beschermen.

Beëindiging / Beperkingen

Virtua.Cloud heeft geen verplichting om de aan u geleverde Diensten te monitoren, echter behoudt Virtua.Cloud zich het recht voor om naar eigen goeddunken de toegang tot door u geleverd materiaal en/of diensten tijdelijk of permanent te beperken in overeenstemming met de Servicevoorwaarden, Acceptable Use Policy en toepasselijk recht.

Sancties

If you violate any of the terms of our Acceptable Usage Policy or Terms of Service, you may be subject to penalties. These penalties are determined at the sole discretion of Virtua.Cloud and may include, but are not limited to, the following:

• Temporary or permanent suspension of your account.
• Fees or charges to cover any direct or collateral damages caused by your activities. These could include, but are not limited to, costs related to excess bandwidth usage, hardware repair or replacement, legal fees, and third-party claims.

If you intentionally violate our policies ('designedly' breach), you agree to pay any damages caused by such activities. An intentional violation is one where you knowingly and deliberately engage in prohibited activities, even after being informed of their prohibitive nature.

'Unwitting violations' are those where you unknowingly violate our policies or where the violation was not intentional. In such cases, penalties may or may not be applied, depending on the specific circumstances of the violation. This includes factors such as your past usage patterns and any prior violations.

If you are assessed penalty fees, you will be notified of the charges and are required to settle them within 7 days. If you fail to settle these charges within the given period, your account may be suspended, and the charges may be forwarded to collections.

We reserve the right to report any illegal activities to the relevant authorities, in addition to enforcing these penalties.

User Responsibility for Content

As a user of Virtua.Cloud, you are solely responsible for all content that you host, post, or share through our services. This includes, but is not limited to, websites, files, software, multimedia, and any other types of data.

You must ensure that your content:

• Complies with all applicable laws and regulations.
• Does not infringe on the intellectual property rights of others.
• Does not contain harmful or malicious software such as viruses, worms, or trojans.
• Does not involve activities that are prohibited by our Acceptable Usage Policy or Terms of Service.

If we discover content that violates our policies or the law, we may take action at our sole discretion. This can include removing the offending content, suspending your account, or reporting the violation to the appropriate authorities.

By using our services, you agree to comply with these content rules and accept the potential consequences of non-compliance.

Verwijdering

Virtua.Cloud kan bepaalde aan u geleverde Diensten offline halen na ontvangst van verwijderingsverzoeken van auteursrechthebbenden of overheden om te voldoen aan de wet. Deze procedure kan worden uitgevoerd met of zonder voorafgaande kennisgeving.
