L'utilizzo del Servizio (di seguito denominato "Virtua.Cloud") e / o dei Servizi forniti da VIRTUA SYSTEMS e dalle sue sussidiarie (di seguito denominati "Virtua.Cloud", "noi", "ci", "nostro") è subordinato alla seguente Acceptable Usage Policy. Do not use the service to send spam or phishing emails.

Do not use the service to mine cryptocurrency without explicit permission.
Do not harass or harm other users or the service itself.
Do not use the service to distribute adult content without appropriate measures.
High-bandwidth activities (streaming, file distribution, relays) are permitted within your server's dedicated bandwidth; above it, order a dedicated bandwidth tier.
Do not try to probe, scan, or test the vulnerability of any system or network.
Do not send traffic from IP addresses you are not entitled to use (no IP spoofing).
You are responsible for the actions performed by your account, including any damages resulting from your actions.
Violation of these rules may result in suspension or termination of your services.

Nessun utilizzo illegale o vietato

Utilizzando il Servizio e / o i Servizi, l'Utente accetta di non utilizzare il Servizio e / o i Servizi per scopi che violino la legge o siano altrimenti vietati da questa Acceptable Usage Policy. I Servizi sono progettati per fornire risorse di cloud computing all'Utente. L'elenco seguente fornisce esempi, non esaustivi, di utilizzi vietati del Servizio e dei Servizi. In conformità con questa Acceptable Usage Policy, l'Utente deve astenersi dall'utilizzare il Servizio e / o i Servizi per tali scopi.

Pornografia minorile
Siti web relativi al gioco d'azzardo senza la dovuta licenza
Software o contenuti piratati
Proprietà intellettuale che non appartiene all'Utente
Invio, trasmissione o elaborazione di Spam o QUALSIASI cosa correlata allo spam
Criptovaluta mining, farming, plotting o qualsiasi utilizzo ad elevato consumo di risorse correlato alle criptovalute
Nodi di uscita ToR. I nodi relay ToR sono consentiti.
Server proxy pubblici
Partecipare ad attacchi DoS/DDoS
Spoofing dell'indirizzo IP di origine (vedere Indirizzi di origine di seguito)
Repeatedly creating and deleting servers to obtain new IP addresses (see IP Address Rotation below)

Indirizzi di origine

Ogni pacchetto che lascia l'interfaccia pubblica dei Servizi dell'Utente deve recare un indirizzo IP di origine che l'Utente ha diritto di utilizzare: un indirizzo che Virtua.Cloud ha assegnato ai Servizi dell'Utente, oppure un prefisso accettato su una sessione BGP con noi o annunciato da noi per conto dell'Utente, ai sensi della sezione Bring Your Own IP Space dei Termini di Servizio o di un servizio di IP Transit da noi fornito. Applichiamo la validazione degli indirizzi di origine (BCP 38): i pacchetti che recano un indirizzo di origine diverso vengono scartati. Le interfacce collegate a una Rete privata fornita da Virtua.Cloud non rientrano nell'ambito di questa regola.

Questa regola non ammette eccezioni e una lettera di autorizzazione non sostituisce la validazione descritta nella sezione Bring Your Own IP Space dei Termini di Servizio. L'invio dai Servizi dell'Utente di traffico con un indirizzo di origine falsificato o comunque non autorizzato, che raggiunga o meno Internet, costituisce una violazione della presente Politica di Utilizzo Accettabile e può comportare la sospensione immediata dei Servizi dell'Utente.

IP Address Rotation

An IP address is assigned to a server for its lifetime. Virtua.Cloud does not change the IP address of a server on request, and deploying servers in order to cycle through addresses is not a permitted use of the Services. Accounts showing this pattern have their minimum charge per deployment raised, as described in the Payment and Billing section of the Terms of Service, and may lose the ability to deploy new servers.

On an account whose pay-as-you-go deployments are on hold for IP address rotation, a period-billed server runs to the end of its paid period: it cannot be cancelled early and no early-termination credit is due.

Notifica alle Autorità

In caso di scoperta o notifica di violazione della Acceptable Usage Policy mediante attività ritenute illegali come specificato sopra, Virtua.Cloud può, a sua esclusiva discrezione, segnalarle alle autorità competenti al fine di proteggere se stessa e gli altri utenti del Servizio e / o dei Servizi.

Risoluzione / Restrizioni

Virtua.Cloud non ha alcun obbligo di monitorare i Servizi forniti all'Utente tramite il Servizio, tuttavia Virtua.Cloud si riserva il diritto di limitare temporaneamente o permanentemente l'accesso a materiali e / o servizi forniti dall'Utente, a sua esclusiva discrezione, in conformità con i Termini di Servizio, la Acceptable Usage Policy e la legge applicabile.

Sanzioni

If you violate any of the terms of our Acceptable Usage Policy or Terms of Service, you may be subject to penalties. These penalties are determined at the sole discretion of Virtua.Cloud and may include, but are not limited to, the following:

Temporary or permanent suspension of your account.
Fees or charges to cover any direct or collateral damages caused by your activities. These could include, but are not limited to, costs related to excess bandwidth usage, hardware repair or replacement, legal fees, and third-party claims.

If you intentionally violate our policies ('designedly' breach), you agree to pay any damages caused by such activities. An intentional violation is one where you knowingly and deliberately engage in prohibited activities, even after being informed of their prohibitive nature.

'Unwitting violations' are those where you unknowingly violate our policies or where the violation was not intentional. In such cases, penalties may or may not be applied, depending on the specific circumstances of the violation. This includes factors such as your past usage patterns and any prior violations.

If you are assessed penalty fees, you will be notified of the charges and are required to settle them within 7 days. If you fail to settle these charges within the given period, your account may be suspended, and the charges may be forwarded to collections.

We reserve the right to report any illegal activities to the relevant authorities, in addition to enforcing these penalties.

User Responsibility for Content

As a user of Virtua.Cloud, you are solely responsible for all content that you host, post, or share through our services. This includes, but is not limited to, websites, files, software, multimedia, and any other types of data.

You must ensure that your content:

Complies with all applicable laws and regulations.
Does not infringe on the intellectual property rights of others.
Does not contain harmful or malicious software such as viruses, worms, or trojans.
Does not involve activities that are prohibited by our Acceptable Usage Policy or Terms of Service.

If we discover content that violates our policies or the law, we may take action at our sole discretion. This can include removing the offending content, suspending your account, or reporting the violation to the appropriate authorities.

By using our services, you agree to comply with these content rules and accept the potential consequences of non-compliance.

Rimozione

Virtua.Cloud può rimuovere determinati Servizi forniti all'Utente tramite il Servizio a seguito di ricezione di richieste di rimozione da parte di titolari di copyright o governi al fine di rispettare la legge. Questa procedura può essere eseguita con o senza previa notifica.
